By entering, browsing and using the Mobile app, you agree to the Mobile app policies, terms and conditions (T&Cs) and you shall be subject to its rules and regulations.

Content:

This Mobile app contains information and data on Aljomaih Automotive Company (AAC) products available in addition to existing brochures, newsletters and promotions. The offers on this Mobile app are only available in the countries indicated for each promotional offer. The content provided on this Mobile app is for advertising purposes only and not for your commercial reuse as a source of information through a third party authorized by law for maintenance and sale. The content of this Mobile app is designed to be as suitable as possible for its purpose. We reserve the right to update information on designs, equipment, specifications and availability without notice.

Product Prices:

The prices offered on this Mobile app for multimedia purposes only are subject to change without notice. The prices offered do not constitute a sales offer. Such prices may differ from prices offered by others. The purchase of AAC’s product is subject to the T&Cs of a separate, documented agreement.

Publication Rights Notice:

The entire content of this Mobile app is protected by international copyright law. The information, texts, symbols and images displayed on the Mobile app are intended for personal use only. You may not edit, activate, license, copy, reuse or publish the information on the Mobile app, in whole or in part, without AAC’s exclusive written permission.

AAC’s team seeks to ensure the accuracy of the information and data provided at the Mobile app. However, the Mobile app may contain bugs that can be human attributed. AAC shall not be deemed liable for the accuracy of the data and information contained on the Mobile app. The data and information provided on the Mobile app are provided to the user without any explicit or implicit guarantee of accuracy. Your reservation and/ or your transaction does not guarantee the availability of the product unless the Sales Adviser confirms the same.

Information, images and symbols presented shall only be provided for guidance to help customer make decisions. AAC shall provide the customer with a first perception of the product and its specifications, which may not be fully applicable to a given product category. Content does not form part of the purchase contract, sales offer, alternative to independent advice, guarantee of complete and accurate product information or a guarantee of the product suitability for specific purposes.

Please contact your sales representative to ensure the product is suitable for your needs and purposes so that you can make an informed decision. AAC bears no liability for the use of the information provided on the Mobile app.

Determination of Liability:

AAC shall not be deemed liable for any direct or indirect, incidental or consequential damages, deriving from the use of the Mobile app. This includes, without limitation, any damage or loss caused by computer viruses that may affect your devices or computer while using the Mobile app.

Mobile app Policy Changes and Updates:

AAC reserves all rights to make changes to the Mobile app Policy according to work needs and objectives and invites you to visit and to read this page from time to time.

By using this Mobile app, the user accepts the following terms and conditions:

  • AAC may modify or update such conditions without notice.
  • You shall be deemed liable for reviewing the latest T&Cs and ensuring that such T&Cs are understood.
  • Evaluation of this Mobile app use is provided frequently and AAC reserves the right to withdraw or amend the Mobile app-provided information and services.
  • Mobile app Users acknowledge that they are +18 years old and have a valid means of payment which they own or have the right to use.
  • The information and services are provided only to Saudi Arabia residents.
  • AAC cannot guarantee the compatibility, reliability, speed, security or accuracy of the mobile apps, that the Mobile app is bug-free or that your computer may be damaged. In accordance with the law, AAC shall not be deemed liable for any damage or loss that AAC may be directly or indirectly exposed to as a result of the use of the Mobile app.


Application, payment and procedures for purchasing vehicles via Mobile app:

  • All prices quoted are retail prices and shall clearly indicate whether or not VAT is included. All prices do not include other applicable charges unless service is available and shall be reflected in the final total purchase value.
  • Any application submitted implies the obligation to purchase the item described in such application, at the price indicated, including any taxes and contributions.
  • You shall be deemed liable for providing accurate and up-to-date information when submitting your application. By submitting your application, you hereby acknowledge that you have reviewed all information relating to your application. AAC shall not be liable for any Purchaser-information errors in submitting your application.
  • No order shall be deemed final unless subject to AAC’s acceptance. We reserve the right to withhold the order for reasons such as unacceptable payment restrictions, legal issues and stock availability limitations.
    The availability of vehicles in your mobile app purchase offer may not be available during the payment processing period, in whole or in part.
  • The quantities and specifications of the vehicles indicated on the Mobile app are estimated and subject to change depending on the availability and speed of the technical update. The technical specifications are confirmed upon confirmation of the order.
  • The transaction and the final values payable by the Purchaser are subject to confirmation by AAC’s Officially Appointed Sales Adviser and shall only become legally binding upon acceptance of AAC’s formal contract of sale, this Confirmation shall be provided by the designated Sales Adviser or by electronic message within (96) hours of AAC’s receipt of advance payment. If your preferred vehicle is not available, AAC shall first seek to find a replacement VIN for the same order, or return the full advance payment.
  • Payments made to AAC on this Mobile app shall be processed by PAYFORT, Saudi British Bank (“SABB”) or any other payment gateway or processing provider (each a “Payment Gateway”) that we could select. All payments made through the Mobile app and all associated details provided by you shall be sent directly to the payment gateway via a secure connection. Payments may be made using any of the selected payment networks, such as Visa Credit Card, MasterCard, mada or Debit Card in Saudi Riyals or any other currency deemed acceptable by AAC from time to time.
    AAC may disclose personal data to a purchaser bona fide or pursuant to government regulations. The Purchaser further acknowledges that personal data may be shared with the vehicle manufacturer.
  • By submitting an online payment, you acknowledge that your personal data shall be used by several parties outside the scope of AAC for reasons pertaining to the completion of transaction. Credit or debit card details or other personal data shall not be stored or used for marketing purposes.
    AAC shall retain all records relating to the purchase for a maximum period of two (2) years.
  • AAC may cancel the sale if faults are discovered in the price or specifications of the vehicle and shall do so before registering the vehicle and shall notify the Purchaser accordingly. Assuming that the alternative is the proposed solution and should the Purchaser refuse to proceed with this alternative, all prepayments or payments shall be fully refunded and no refunds shall be made for online payments.
  • If the Purchaser is unable or refuses to pay the price of the vehicle in full within eighty-four (48) hours of reservation, AAC may cancel the purchase order or resell the vehicle to any other party without further notice to the Purchaser.
  • If AAC fails to deliver the vehicle on the agreed-upon date due to procedures or circumstances within the Purchaser’s control, AAC shall store the vehicle and the Purchaser shall be liable for any storage cost of SAR 1,000. per month or an equivalent calculated as a percentage.
  • The Purchaser shall be assigned a Sales Adviser who shall be contacted for any vehicle issues that arise prior to vehicle registration. If the Purchaser agrees, the Purchaser acknowledges having taken delivery of the vehicle as agreed with the Sales Adviser. The Purchaser further acknowledges that during the vehicle preparation process, the vehicle may be driven and tested to ensure its quality and that some minor defects may need to be restored to its original condition without impacting the quality or warranty of the vehicle.


Refunds shall be made subject to the following conditions:

  • Refunds shall only be made to the original method of payment.
  • Refunds may be less than the amount originally paid due to considerations such as currency, redemption fees, etc.
  • Refunds for reservations not attributable to the Purchaser’s fault shall be fully refunded.
  • Refunds or returns of registered and fully paid vehicles shall not be accepted or allowed and the sale is final if the defect is not caused by AAC).
  • Refunds shall only be made if the original receipt slip is available.
  • The reimbursement period is twenty-one (21) working days.
  • If the Purchaser does not complete the purchase process for any reason, AAC may withhold 10% of the advance payment value, as long as the amount withheld is not is not less than SAR 500 and not more than SAR 1000.
  • The purchase cannot be canceled after the number plates have been issued.
  • In case any transaction found to be incompatible with the Saudi laws, AAC reserves the right not to proceed with the transaction and to immediately cancel the sale.
  • When in doubt, the law shall apply all appropriate legal procedures and AAC shall work closely with the payment gateway provider to investigate, collect and share information about the suspected act with the law enforcement authorities.


Warranty:

You acknowledge that you shall read and properly understand the manufacturer’s T&Cs in connection with any maintenance, warranty or extended warranty provided by the manufacturer or additional services of such type of vehicle services. It is the Purchaser’s liability for reviewing such T&Cs. For more details, see the manufacturer’s warranty, service, maintenance and owner’s manual.

Sales Policies and Procedures for Vehicles Available in Stock:

  • All vehicle sales procedures and transactions are carried out at authorized Aljomaih auto shows and through authorized sales representatives.
  • Visit one of the authorized Aljomaih auto shows and get informed by the sales representatives of the models/specifications/colors and prices available.
  • The sales representatives explain the specifications, define the customer’s needs and agree therewith upon the terms of payment and vehicle receipt.


If the customer agrees, a detailed contract of sale is drawn up which includes the specifications, the supplements (if any), delivery term and T&Cs, which include the following:

  • The minimum amount to reserve the vehicle subject of contract is SAR 5000 and the final amount shall be completed within two (2) working days following the date on which the contract was concluded or following the end of the Gregorian month, whichever occurs first.
  • The term of vehicle delivery to the customer shall be within fourteen (14) working days from the date on which the full value of vehicle was paid in case of cash purchase, or from the date on which the cheque advance payment voucher warranty was received by the Company in their accounts, or from the date on which the Company received the financing agency’s approval for the delivery of the vehicle to the customer, with the completion of insurance being linked in all the foregoing cases, unless prevented by any governmental control or procedure.
  • The vehicle warranty booklet (issued by the manufacturer) is the main reference for determining the validity of the warranty in the period and distance indicated therein, commencing from the date on which the purchase invoice is issued. With the approval of the contract by the customer, the warranty booklet shall be deemed an integral part of the contract and shall be binding upon both parties, except for previously registered vehicles, the warranty is indicated in the purchase contract or in a separate document.
  • The terms, conditions, rights and obligations of the extended warranty shall be contained in a separate document obtained by the customer in accordance with the requirements of the Company granting the extended warranty and any maintenance under the extended warranty shall be subject to the approval of the Company granting such extended warranty.
  • The customer shall receive the vehicle no later than fourteen (14) days from the date on which the form is issued, and in case of delay, an amount of SAR 50 shall be calculated for each day of delay.
  • In the occasion that the purchase is canceled by the customer, 10% of the cost of advance payment may be deducted, provided that the deducted amount is not less than SAR 500 and no more than SAR 1,000, and the purchase cannot be canceled after the issuance of plates.
  • The Company may cancel the sale procedures in the occasion that the Purchaser is not able to provide the files required to register the vehicle in his name or if this is unapplicable for a cause pertaining to the Purchaser. The Company may solely terminate the sale within a period not exceeding seven (7) working days from the date on which this contract is executed or the end of the Gregorian month (whichever occurs first), and the Purchaser may not claim any rights or reimbursements due to the termination of the sale.
  • In the occasion of sale through a financing agency, the Company’s approval to sell the vehicle to the customer shall be by signing the contract of sale and the Company’s receipt of the financial credit from the Company-approved financing body. The Company’s mere receipt of the advance payment or documents does not imply its approval of the sale.
  • In the event of a delay in the delivery of the vehicle to the customer beyond the specified date, the latter shall be compensated according to the applicable regulations and controls.
  • The customer accepts that the Company’s method of communication therewith shall be by phone call, SMS, WhatsApp or electronic messages, and the message sent by any such means shall be legally effective without any objection on the part of the customer.
  • The customer authorizes the Company to implement the additions that the customer has requested to be added to the vehicle before the vehicle is delivered thereto, either by the Company and by the parties contracting therewith, and acknowledges that the value thereof is not refundable in case of cancellation of the purchase.
  • If the customer wishes to change the color, model or specification of the vehicle, this contract shall be terminated and a new contract shall be signed, provided that the customer’s request is available in the Company’s warehouses.
  • The provisions printed in the contract shall be authoritative in case there is no sign of any scraping, addition or comment thereon.
  • The customer shall bring the vehicle to one of the Company’s maintenance centers in the event that a repair campaign has been reported by the manufacturer, failing which the Customer shall release the Company from any obligation or compensation.
    The Company shall inform the customer of any damage that may occur to the vehicle during the vehicle equipping period.

Policies and Procedures for Reserving New Vehicles: An Out-of-Stock Vehicle:

  • If the vehicle is not available in stock, the customer can reserve one of the vehicles shipped from the supplier/manufacturer if a similar vehicle is available.
  • In the event that the vehicle is not available in ACC throughout Saudi Arabia and there are no nearby shipments, the sales managers shall examine the vehicles reserved for distributors to seek a vehicle compatible with the customer’s reservation request.
  • Vehicles are reserved for customers via the Company’s electronic system, and the customers’ signature on the agreement is obtained indicating the expected date of arrival of vehicles.
  • The minimum amount to reserve the vehicle subject of contract is SAR 5000, and the final amount shall be completed within forty-eight (48) working days from the date on which the customer is informed of the arrival of vehicle at the agency headquarters.
  • The sufficient time for the arrival of vehicles shall be determined, and any delay is taken into consideration when preparing the reservation, provided that the delivery procedure takes place within fourteen (14) days from the date on which the vehicle arrives to the Company’s auto shows/warehouses and all related procedures and transactions shall be finalized.
  • In the event that the vehicle arrives late or the vehicle cannot be delivered on time and for reasons beyond the Company’s control, the customer shall be contacted to agree on a new date or cancel the reservation in case the latter fails to find an agreed-upon solution.
  • In case of cancellation of the purchase by the customer, 10% of the value of the advance payment shall be withheld, provided that the amount withheld is not less than SAR 500 and not more than SAR 1,000. The purchase cannot be canceled after the number plates have been issued.
  • The vehicles are not reserved for customers unless shipment is confirmed to avoid cancellations or specification changes by manufacturers. This does not include orders for vehicles with special specifications (special orders), whereas sales representatives are contacted to determine the date of receipt after communicating with the manufacturer.
  • No more than one vehicle of the same type is reserved for individual customers during the current calendar year, in particular for vehicles short of supply until the completion of existing reservations, provided that it is agreed with the customers that the first vehicle shall be delivered according to the times of availability, and the other vehicle(s) shall come according to a schedule allowing the supply of vehicles to the widest possible segment.
  • The reservation list is available to all customers according to reservation priority and stock availability, and the delivery is scheduled according to the priority on the reservation list.
  • It is prohibited to sell reservations or to transfer the same from one consumer to another. The consumer may acquire the reserved vehicle. In the event that the consumer fails to complete the purchase process, he shall be granted a specific opportunity of 48 hours, and the reservation is canceled when the time expires and the vehicle is made available to the next customer in the reservation list.
  • Upon arrival of the reserved vehicle at the Company’s auto shows/warehouses, approved vehicle sales procedures apply and all T&Cs apply, taking into consideration the new vehicles sale procedures.


Vehicle Delivery Procedures:

  • The vehicle shall be handed over and taken over at an AAC’s facility to be specified by the Sales Adviser, which facility shall exclusively be amongst the Company’s facilities within Saudi Arabia, and you shall hereby agree to make all necessary arrangements to receive your vehicle.
  • You shall not be able to receive your vehicle until you have gone to AAC’s designated place in person and you have formally signed the required Contract of Sale document, in addition to verifying your ID card/ residence permit.
  • The exact date of vehicle delivery is fourteen (14) days in accordance with the contract of sale. This period may be affected by circumstances beyond AAC’s control, including without limitation: government procedures to register the vehicle, issuance of insurance as well as any agreed-upon corrective action taken after inspection of the vehicle and before delivery, if the vehicle shall be transported from one city to another, the customer acknowledges any If the vehicle needs transportation from one city to another, the customer acknowledges any potential delays.
  • Ownership of the vehicle can only be transferred upon reconfirmation of the price and full payment of the vehicle price with all registration and service payment obligations, whether such obligations is government or private.
  • Releasing CAA from any and all liability relating to the vehicle upon delivery to the customer and signature on the delivery note, except for after-sales service obligations such as warranty and maintenance (“if applicable”).


Periodic Maintenance:

  1. The customer shall receive the warranty and maintenance booklet and the user manual, which shall explain the warranty conditions and the periodic maintenance schedule.
  2. Periodic maintenance shall be carried out in the Company-approved maintenance centers and shall be carried out according to the schedules indicated by the manufacturer.
  3. The Company may suspend the basic and/or extended warranty, or cancel both, in the event of a lack of maintenance recommended by the manufacturer or failure to carry out such maintenance within the specified dates.
  4. If the basic warranty is void due to failure to perform recommended periodic maintenance, the extended warranty shall be suspended and terminated accordingly.
  5. You can contact the Customer Service Center to arrange a regular maintenance appointment or through the electronic means that the Company makes available to its customers.

Privacy Policy:

If you choose to open an account, using your e-mail address (rather than signing up with a social media account), our technical provider, shall hold and store your email address for creating and maintaining an account. If you then take steps to complete your application for financing using the same e-mail address in your account, we shall store your application information in your account so that you can come back later to complete your application. The technical provider provides us with your data and we may send you a follow-up email if you open an account or continue as a guest but do not proceed completing the application for financing.

Due to the continued shortage of semiconductor supplies around the world, GM vehicles manufactured after 19 July 2021 may not have some standard features and options.

The delivery time may be affected if the reserved vehicle is in a city different than yours. Our sales team will contact you to inform you of the exact delivery time of your vehicle.

When purchasing 2021 models, the customer shall be deemed liable for shipping costs should they be not in the same location as the vehicle.

Inspection of the Vehicle:

The customer may inspect the vehicle on the ground and represents that he has seen the vehicle specifications, color and the equipment provided and shall sign the ad hoc form.
